You could impersonate that specific user in your code and then request all publications as them. This should give you the complete list that they're able to access. Alternatively, you could get every publication and then iterate over them to determine whether the user (or a group that they're a member of) has any rights on that publication.

You are doing an upgrade from 2013 to 8.5 so that means that all your custom assemblies must also be upgraded. What it means is that they (in their implementation reference 2013 dlls.) The solution was very simple. I created a new Business Process Type, based on the Topology Type of the Development environment and added that to the publication. So publishing works now. Next step is implementing the same Topology Type on all servers, but that's not part of this question.
